Standard Terms and Conditions of Sale

  1. Delivery and Acceptance
    1. All delivery dates and times quoted for goods or services are estimates only. SKYROCKIT shall not be liable for any loss or damages arising from any failure to deliver or delay in delivery under any circumstances.
    2. Customers shall remain obligated to accept and pay for goods or services regardless of any delivery delays. SKYROCKIT reserves the right to make partial deliveries, each deemed a separate sales contract. Cancellation of the contract is not allowed if goods or services have been delivered by the courier.
  2. Order Cancellation
    1. SKYROCKIT reserves the right to cancel sales orders without prior notice under the following conditions:
      1. Payment has not been received within 7 days of the order.
      2. Items ordered cannot be sourced.
    2. Delivery charges are borne by the customer.
  3. Risk and Title
    1. Risk for all products transfers to the customer upon delivery.
    2. Payment terms are generally cash with order or cleared funds before delivery. An official receipt will be provided for cash payments, and a receipt for cheque payments upon request.
    3. Until full payment is received for all goods supplied to the customer, the goods remain the property of SKYROCKIT. If goods are affixed or added to other items, the customer acts as an agent for SKYROCKIT, and SKYROCKIT retains full legal and beneficial title to the newly created product.
  4. Client Terms and Conditions
    1. The client explicitly waives its own standard terms and conditions, even if drawn up after these terms and conditions of sale. Any derogations must be expressly agreed upon in writing in advance.
  5. Performance of Services
    1. SKYROCKIT will endeavor to provide performant services within agreed timeframes but cannot guarantee specific results. SKYROCKIT shall not be required to appear as a third party in any claims for damages filed against the client by an end consumer.
  6. Payment Terms
    1. Invoices are payable within 21 working days unless another timeframe is indicated on the invoice or order. In the event of non-payment by the due date, SKYROCKIT reserves the right to charge interest at 10% of the outstanding amount and suspend services without prior warning.
    2. If a payment is still outstanding more than 60 days after the due date, SKYROCKIT may engage a debt recovery company, with all legal expenses payable by the client.
  7. Legal Governance
    1. All contractual relations are governed exclusively by Australian law.
  8. Confidentiality of Quotes
    1. SKYROCKIT provides personalized quotes in confidence. These quotes must not be shared without prior consent from the Director of SKYROCKIT.
